GENERAL CONDITIONS OF CONTRACT FOR TOUR PACKAGES

OMARSTIE TRAVEL CONSULT LIMITED

  1. For local (domestic) tours, each tour is subject to a minimum number of participants (usually 10) before tour starts, unless arrangements are made by client with OTCL for lower numbers. Tours of various categories, prices, duration and types are available for large or small groups and for the general public, corporate institutions, VIPS, government officials, educational institutions, associations, embassies & diplomatic missions, parliamentarians, religious organisations, inter alia.
  2. The itinerary remains unchanged throughout the tour. The tour guide, in consultation with the driver, reserves the right to alter the route in the event of any unforeseen situations. Dictating the route of a tour by a client is discouraged. Pick up and drop off points remain as announced.
  3. Due to reservation conditions provided by principals at the destination, an initial deposit of 60% of the advertised per person cost of the packaged tour may be payable when registering with OTCL for the tour, in order to have your seat secured. Total and final cost needs to be settled not later than three days before tour commences. Payments may be made direct to OTCL offices, its agents, bankers or via mobile money (mtn, vodafone cash). Reservations are made on first-come, first-served basis. We encourage our domestic clients to take advantage of our EASY PAYMENT PLAN, in which payment can be effected in smaller amounts over a period and irrespective of the amount. The total tour price however needs to have been settled in full three days before the tour takes off. Should the client decide to discontinue with the tour and payments, a refund of the deposits shall be paid.
  4. Generally, aside of specially-arranged tours, all tours are advertised four weeks prior to take off. The same tour may be re advertised for repeat.
  5. Per person prices depend on type/quality of accommodation and transport used in the package. Accommodation is categorized from tent, hostel/budget or guest house to three, four-or-five star rating. ADVERTISED TOUR PRICES ARE SUBJECT TO CHANGE and any applicable surcharges /increases must be settled in order to have reservations reconfirmed. Tours can be tailor-made to suit client requirements, based generally on the size of the group.
  6. Inclusion and exclusion details depend on type of tour, but generally, included in all packages are the following:
  • ACCOMMODATION (INCLUDED ON OVERNIGHT PACKAGES UPWARD. ACCOMMODATION DOES NOT FEATURE ON FULL DAY PACKAGES).
  • TRANSPORT (INCLUDING FUEL COSTS)
  • SIGHTSEEING
  • MEALS (TO BE SPECIFIED)
  • DRINKS (TO BE SPECIFIED)
  • ATTRACTION VENUE ENTRY FEES
  • TOUR GUIDE CHARGES
  • ADMINISTRATIVE CHARGES

 

Not included in all packages are:

  • EXTRA MEALS & DRINKS TAKEN BY THE CLIENT
  • LEVIES ON CAMERA AND OTHER RECORDING EQUIPMENT AT ATTRACTION VENUES
  • ENTERTAINMENT & PERSONAL TRIPS NOT INCLUDED IN THE ADVERTISED PACKAGE
  • OTHER ITEMS OF PURELY PERSONAL NATURE SUCH AS TOILETRIES AND CONVENIENCE ITEMS
  • TIPS

  1. Late bookings (bookings made four days before tour commences) shall attract full (100%) payment.
  2. Minors, children and persons requiring special care need to be accompanied by an elder, unless the tour is specifically planned for such ages, in which case OTCL engages professionals for the purpose. In the case of an advertised tour for minors, OTCL shall be responsible for their care.

 

  1. CANCELLATIONS & REFUNDS & MODES OF PAYMENT

If OTCL cancels a tour before the departure date/time due to uncontrollable circumstances or in the event of too few participants registering, a refund shall be done of the total payments made, which amount shall constitute a final settlement by OTCL to the client. If this cancellation by OTCL comes after the tour has taken off, the full refund of payments applies. OTCL reserves the right to refuse a client a reservation or to discontinue their participation at any point of the tour if their presence on the tour compromises the safety and comfort of the rest of the group.

If the CLIENT cancels their tour for whatever reason and at any time before tour commences, a deduction of administrative costs (20%) shall be made from deposits earlier paid. If this cancellation by the client comes while the tour is under way and at any stage of it, no refund shall be made.

OTCL shall duly inform booked clients in the event of any cancellations or major alterations to the tour in good time by email, sms text or watsapp. Similarly, clients wishing to cancel a tour shall be required to inform OTCL no less than three (3) days before the tour starts.

Payment for any products and service purchased from OTCL shall be made by the following means:

  • Cash (direct to our offices)
  • Mobile Money
  • To our bankers
  • Credit or debit card (processing fees included)
  • Wire Transfer
  1. WAIVER OF RESPONSIBILITY

Clients’ contract is with OMARSTIE TRAVEL CONSULT LIMITED or OTCL.                         The company makes every effort in ensuring that every tour lives up to client expectations and that all advertised items are provided. Safety and comfort are OTCL’s priority. However, in the performance of its operations, the company may involve, engage or subcontract to trusted third parties in the provision of advertised products and/or services. In the event of omission or commission on the part of these third parties, OTCL will not be held liable for loss or damage to client property, or for injury/death to persons booked on our tours. All travel on transportation used by OTCL is fully insured, covering all passengers at any time. OTCL ensures the use of high standard and well-maintained vehicles of all types on all tours.
